Mandatory Commercial Recycling Background
In working towards waste diversion goals laid out in the Climate Action Plan, City Council adopted Ordinance 2899 in March 2023. Among other things, this established a recycling mandate for commercial waste customers which requires compliance by July 31, 2024, with fines beginning in March 2025.
The mandate states that recycling capacity shall be at least equal to fifty percent (50%) of trash service capacity when container size, number and collection frequency are considered.
Example: A property has an 8-yard trash dumpster which is picked up once a week. This means they have a capacity of 8 yards of trash weekly and would need at least 4 yards of recycling capacity each week.

What is a commercial waste customer? Does this apply to me?
Commercial waste customers are any triplexes or larger residential units and any non-residential customer including but not limited to stores, hotels, markets, offices, restaurants, warehouses, institutions, and community and government operations receiving curbside waste collection services.
What do I (a property manager/owner/HOA) need to do?
- Provide appropriate recycling capacity (at least 50% of trash) on your property. OR
- Complete the Recycling Waiver Application (Request Form) if you meet one of the following conditions:
- Extreme space constraints or excessive costs in addressing those space constraints. Ex: Need to request a waiver in order to address space constraints or need to request a waiver to the 50% capacity requirement due to extreme space constraints.
- Sharing recycling space with another commercial property.
- Making use of an alternate recycling option. Ex: You bring waste and recycling directly to a waste facility instead of having it picked up.
What is the application fee for the Recycling Waiver?
The fee is $260, payable through the CityView portal during the application process.
How do I let people know about the recycling containers and how to use them?
As recycling becomes available on your property, it will be key to educate residents, employees, customers and visitors about proper waste disposal. Signage is available through the City. Learn about How to Recycle Right in the 'Boat here.

Complete the Recycling Waiver Application if you meet one of the following conditions:
- Extreme space constraints or excessive costs in addressing those space constraints.
- Sharing recycling space with another commercial property.
- Making use of an alternate recycling option. Ex: You bring waste and recycling directly to a waste facility instead of having it picked up.
The Recycling Waiver Application is intended for those properties who fall into one of the three categories above. If approved, the applicant will be issued a recycling waiver for a period of two years, at the end of which they must either be in compliance or submit a new one-year application.

The Recycling Waiver Application fee is $260, payable in the CityView portal during the application process.
It is recommended to get all submittals together in a digital folder for easier submission when it comes times to submit into the CityView portal.

-Demonstration that the minimum recycling capacity defined in subsection 19-29(a)(1) is met.
-Description of the constraints, conditions, and current trash collection container placement.
-Specific request to waive or modify Ordinance No. 2899 requirements.
Proof of collection and service such as receipts or bills. (Scan or photo)
Digital photographs of the current trash and recycling areas, including waste screening enclosure.
